EGGTART PLUSH FAKES!!!!!!!!






Mine is on the left but the fake is on the right with the chain attached.

I was at a chinese mall and was surprised and sort of not surprised to find a fake of my eggtarts..
The company is called xiangxing and it is called MINI- Q..
i think the tag is fake as well as we looked and found no such company online..

Do you have any advice what i should do? I don't really think i can do much but i wanted to give you all a heads up anyway.

You should go to the place that is selling them and tell them these are fakes and ask who is selling them the product. I would say that you're contacting a lawyer, hearing that they may not want problems and give you the information you need.

Could you not go to the store that was selling it and get some info? They have to know where it's coming from if they are selling it. If you get a contact you should write them a cease & desist, if they do not respond, seek legal help. I'm no expert but that is what I would do.
I would also 'scorch the earth' so to speak, blog about it, tell everyone you know not to buy the fakes!

AARGH! How heart-breaking! Must have broke your heart even more to have to purchase one!! Did the store have any info as to where they purchased it?

Yeah the store guy gave the toy to me i didn't pay ,
it was the only one in the store, and he said he got it shipped
from a friend who went to the night market in china and just shipped
an assortment of stuffed toys he found.

So i think it was a pretty small run they did which is what i put together
when my cousin searched the web in chinese nothing came up luckily.

That is terrible! There is a woman named Hillary Lang (she runs the blog Wee Wonderfuls) and she had a similar problem a couple of years ago. You could look her up and send her an e-mail as to what she did about it, she seemed to come out of the sitution pretty well.

In some cases, people can sue the shop, distributor who are carrying, selling the fake goods, not the manufactures. Since most of manufactures are oversea, you probablly not be able to take them to the court........by the way you are male right?.....on plushyou blog said you r female.....

That company makes fake iPods too. I have no idea how they can get away with it. I don't have any advice except to say I'm sorry.

I've had the same issue with my work. One example I was walking through a mall in Asia and saw someone wearing a t-shirt with my design on it and I know that that design has never been printed on a t-shirt.

I've contact my lawyer about these copyright breaches but if you are dealing with China it is very difficult and expensive to prosecute. Mainly because most of these companies are fly by night companies that quickly produce a lot of products and then disappear. Also because the Chinese Government is not concerned about copyright laws.

But good luck, it's not a nice experience to see you hard work ripped off and a also loss of potential income too.

thanks for all the advice, i agree onno knumers, it is pretty useless to sue china, i only copyrighted in canada and the us. Not in china..the laws just are not in the artist's favor there.

i am so sorry!! in spain we have "safe creative" company that defends our works by intelectual copyrights...maybe you have to look something similar in your country to make a copyright of your work, then know how they can help you.

Sorry for my english, is not my mother tongue, and i am new in this things of blogs.

oh my, I have read about this sort of thing all over the place. One blogger had a family photo used in an advertisement. Wish I still had the link.

I saw a Taiwanese online shop selling the imitation a few months back so it might be sold throughtout Asian in the little stands.
